Terms & conditions

Please read the terms and conditions carefully before starting.

Effective Date and Acceptance

These Terms and Conditions are effective from August 9, 2026.
By creating an account, selecting or purchasing a plan, connecting a payment method, depositing funds, enabling automated trading, following a trader, or otherwise using Ourfinex, you confirm that you have read, understood, and accepted these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions, you must not subscribe to, fund, activate, or use Ourfinex services.

These Terms form a legally binding agreement between you and the legal entity operating Ourfinex.

You should review these Terms carefully before activating a service or enabling automated trading.

Eligibility and Registration

You must be at least 18 years old and legally capable of entering into a binding agreement.
You must provide complete, accurate, and current registration information.
You may not create or operate an account on behalf of another person unless you have valid legal authorization.
You are responsible for maintaining the security of your password, verification codes, email account, connected payment methods, and other account credentials.
You must immediately notify Ourfinex if you suspect unauthorized access to your account.
Ourfinex may reject, suspend, restrict, or close an account if information provided by the user is false, incomplete, inconsistent, misleading, or cannot reasonably be verified.

Identity Verification and Compliance

Ourfinex may require identity verification, proof of address, source-of-funds information, payment-account ownership information, wallet ownership information, or other documents reasonably required for legal, security, fraud-prevention, or compliance purposes.
Ourfinex may conduct anti-money-laundering, sanctions, fraud, identity, payment, and transaction-monitoring checks before or after account activation.
You agree to provide requested verification information within the period specified by Ourfinex.

Ourfinex may delay or restrict service activation, deposits, trading, withdrawals, invoices, payments, or other services until required checks are completed.
Ourfinex may refuse services to users or transactions associated with prohibited, sanctioned, unsupported, or high-risk jurisdictions.
Ourfinex may report suspicious or legally reportable activity to competent authorities where required by applicable law.

Description of the Ourfinex Service

Ourfinex provides service-based automated trading tools and related trading services.
Depending on the selected plan, services may include automated trading, the Ourfinex Trading Bot, access to selected Top AI Traders, AI Guard, Market Sentiment Analysis, Rate Guard, risk-management controls, account monitoring, and related platform functionality.

Ourfinex may use trading systems, algorithms, traders, strategy providers, brokers, liquidity providers, artificial intelligence systems, and other third-party infrastructure to provide the service.
Availability of individual features may depend on your plan, account status, jurisdiction, broker, trading platform, technical availability, and compliance requirements.
Ourfinex does not provide a guarantee of investment performance, capital preservation, or profit.

Ourfinex Plans

Rate Guard is not included in Pro unless otherwise stated in the platform.
Ourfinex receives 30% of eligible trading profit generated under Pro, and the client retains 70%.

The Elite plan requires an eligible trading account balance of at least USD 50,000.
Elite includes automated trading and access to the Ourfinex Trading Bot.

Elite users may follow up to 15 eligible Top AI Traders.
Elite users may configure daily trading risk within the supported range of 0.25% to 7% of applicable trading capital.
Elite includes AI Guard, Market Sentiment Analysis, and Rate Guard.
When Rate Guard is enabled, the system may prevent eligible trades with a Ourfinex signal rating below 1.8 from being executed.

Ourfinex receives 30% of eligible trading profit generated under Elite, and the client retains 80%.

Monthly Profit-Sharing Settlement

Eligible trading profit is normally calculated monthly.
Any Ourfinex profit-sharing amount due is calculated using the percentage applicable to the active eligible plan.

The monthly profit-sharing percentages are 40% for Standard, 30% for Pro, and 20% for Elite.
If there is no eligible trading profit for the monthly calculation period, no Ourfinex profit-sharing amount is due for that period.

Payment Authorization and Methods

If you connect and authorize a supported payment method, you authorize Ourfinex and its authorized payment providers to collect amounts validly due under these Terms.

Profit-sharing invoices may be paid using supported cryptocurrency, Visa, or Mastercard payment methods where available.
Any automatic or recurring payment remains subject to the specific authorization provided by you and applicable payment laws.
You are responsible for ensuring that your selected payment method remains valid and has sufficient available funds.
Revoking a payment authorization does not cancel amounts that became validly due before the revocation became effective.

Service Deactivation

You may stop using Ourfinex services or disable automated trading subject to platform functionality and any required operational steps.

Deactivation does not eliminate valid profit-sharing invoices, trading losses, third-party costs, taxes, or other amounts that became due before deactivation became effective.
If automated trading remains active until the effective deactivation time, trading activity occurring before that time remains subject to these Terms.
If you require assistance, you may contact Ourfinex support.

Plan Eligibility and Changes

Your applicable plan is determined by the verified trading account balance and the eligibility thresholds stated in these Terms.
A change in account balance may result in a change of plan, available features, trader-following limits, and profit-sharing percentage.
Ourfinex may apply a plan change immediately, at the next calculation period, or at another time displayed in the platform where reasonably necessary for operational or accounting purposes.
A plan change does not cancel invoices or profit-sharing obligations that accrued before the change became effective.

Automated Trading

All Ourfinex plans include automated trading functionality.

Automated trading may open, modify, manage, or close eligible trading positions without requiring manual approval for each individual trade.
By enabling automated trading, you authorize the Ourfinex trading system to execute eligible trading activity according to the configuration and features available on your account.

Automated systems may experience delays, errors, outages, execution differences, connectivity failures, broker limitations, or other technical issues.
Ourfinex does not guarantee that an automated strategy will execute every signal or achieve any particular result.

Top AI Traders and Follow Limits

Ourfinex may display selected traders, strategies, or automated profiles as Top AI Traders or under similar rankings.
Standard users may follow up to 4 eligible Top AI Traders.
Pro users may follow up to 12 eligible Top AI Traders.
Elite users may follow up to 15 eligible Top AI Traders.
Trader availability, rankings, statistics, strategies, and eligibility may change at any time.
A trader ranking, score, historical return, popularity metric, or Top AI Trader designation does not guarantee future performance.
Ourfinex may remove, suspend, replace, or restrict a trader or strategy for risk, performance, operational, compliance, technical, or commercial reasons.

Daily Risk Settings

Users may configure their supported daily trading risk between 0.25% and 7% of applicable trading capital.
The selected risk setting represents a trading-risk parameter and is not a guaranteed maximum loss.
Market gaps, leverage, slippage, liquidity conditions, broker execution, correlated positions, rapid market movements, and other factors may cause actual losses to differ from the configured risk setting.
Increasing the risk setting may increase both potential gains and potential losses.
A lower risk setting does not eliminate the possibility of loss.
You are responsible for selecting a risk level appropriate for your own financial circumstances and risk tolerance.

AI Guard

AI Guard is available under the Pro and Elite plans unless otherwise stated in the platform.
AI Guard provides an additional artificial-intelligence-based assessment of eligible trading opportunities.
AI Guard may analyze signals, market information, strategy information, technical data, or other factors available to the system.
AI Guard may approve, filter, delay, reject, or otherwise affect an eligible trading opportunity depending on system configuration.
AI Guard is a decision-support and filtering feature and does not guarantee profitable trades, prevent all losses, or eliminate market risk.
AI-generated assessments may be incorrect, incomplete, delayed, or affected by inaccurate or unavailable data.

Market Sentiment Analysis

Market Sentiment Analysis is available under the Pro and Elite plans unless otherwise stated in the platform.
The feature may analyze available market sentiment, news-related signals, trading activity, price behavior, or other market data as part of the trading-analysis process.
Market sentiment may change rapidly and may not accurately predict future price movements.
Market Sentiment Analysis is provided as an additional analytical input and does not guarantee profitable trading results.

Rate Guard

Rate Guard is available under the Elite plan unless otherwise stated in the platform.
Elite users may be permitted to enable or disable Rate Guard.
When enabled, Rate Guard may prevent eligible trades with a Ourfinex signal rating below 1.8 from being executed.
A signal rating is an internal analytical measure and should not be understood as a probability of profit or a guarantee of trading performance.
A trade with a rating of 1.8 or higher may still result in a loss.
A trade below the Rate Guard threshold may in some circumstances have been profitable if executed; filtering such a trade does not create liability for missed profit.
Ourfinex may update its rating methodology, calculation process, data inputs, or technical implementation where reasonably necessary.

Profit Sharing

Ourfinex receives a percentage of eligible trading profit based on the active eligible plan.
Under Standard, Ourfinex receives 40% of eligible trading profit and the client retains 60%.

Under Pro, Ourfinex receives 30% of eligible trading profit and the client retains 70%.

Under Elite, Ourfinex receives 30% of eligible trading profit and the client retains 80%.

Profit sharing applies only to eligible trading profit and is not charged merely on the amount of original trading capital deposited by the user.
The applicable percentage is based on the plan active for the relevant calculation period, subject to adjustments required for plan changes, corrections, or account

Eligible Trading Profit

Eligible trading profit generally means net realized trading profit determined for the applicable calculation period.
Realized trading losses, broker commissions, swaps, financing charges, execution costs, and other directly related trading costs may be deducted when determining eligible trading profit.
Open or unrealized profit may be excluded until the relevant position is closed.
Deposits, returned principal, transfers of capital, credits that are not trading profit, and similar non-trading amounts are not treated as eligible trading profit merely because they increase the displayed account balance.
Ourfinex may correct calculations affected by confirmed broker adjustments, duplicated records, reversed transactions, technical errors, pricing errors, or other verified accounting discrepancies.

Monthly Profit Calculation

Eligible trading profit for profit-sharing purposes is normally calculated on a monthly basis.
The monthly calculation may use Ourfinex internal records, broker statements, trading-platform records, payment records, and other relevant account data.
Displayed profits or estimates may remain provisional until the monthly calculation has been completed.
If no eligible trading profit exists for the applicable monthly period, no Ourfinex profit-sharing amount is due for that period.

Ourfinex may carry forward corrections, adjustments, or previously recognized losses where reasonably necessary to avoid charging profit sharing on amounts that do not represent net eligible trading profit.

Monthly Profit-Sharing Invoice

Ourfinex issues a monthly invoice for any profit-sharing amount due.
The invoice is calculated using eligible trading profit and the applicable percentage of the active eligible plan.
The applicable percentages are 40% for Standard, 30% for Pro, and 20% for Elite.
The invoice may be paid using supported cryptocurrency, Visa, or Mastercard methods where available.
The invoice or account dashboard may provide details of the applicable profit amount, profit-sharing percentage, adjustments, and total amount due.
You are responsible for reviewing invoices and promptly reporting any suspected calculation error.

No Profit and No Profit-Sharing Charge

If there is no eligible trading profit for a monthly calculation period, Ourfinex does not charge a profit-sharing amount for that period.

Trading losses do not create a payment obligation to Ourfinex as profit sharing.

Nothing in this section limits legitimate third-party trading costs, payment-processing fees, taxes, or other separately applicable charges.

Failed or Unpaid Amounts

If a profit-sharing invoice or other authorized payment fails, Ourfinex may attempt to collect the valid amount again where permitted by the applicable payment authorization and law.

Ourfinex may notify you that a payment has failed and request that you update or use another supported payment method.
Ourfinex may restrict new automated trading activity, plan features, or other services while valid overdue amounts remain unpaid.
You remain responsible for valid amounts that became due under these Terms, subject to your legal rights to dispute unauthorized or incorrect charges.

Deposits and Supported Assets

Where Ourfinex permits account funding or trading deposits, supported assets, payment methods, minimum amounts, and networks will be displayed in the user dashboard.

If cryptocurrency deposits are accepted, you must use only the asset, blockchain network, and destination address displayed by Ourfinex.

Sending an unsupported asset, using an incorrect network, or sending funds to an incorrect or expired address may result in permanent loss.
Submitting a transaction hash does not by itself prove or complete a deposit.
Blockchain deposits may require network confirmation before being credited.
Network fees, exchange fees, wallet fees, gas fees, conversion costs, or other third-party transaction costs may be borne by the user.

Custody and Use of Deposited Trading Funds

Where Ourfinex receives or controls deposited trading funds, you authorize Ourfinex to receive, hold, transfer, allocate, or convert those funds as reasonably necessary to provide the trading service.

Funds may be transferred to brokers, liquidity providers, custodians, operational wallets, trading accounts, or other service providers involved in providing the service.
Operational accounts may aggregate assets belonging to multiple users where legally and operationally permitted.
Your economic account balance is determined using verified deposits, trading results, withdrawals, fees, adjustments, and Ourfinex internal account records.

Ourfinex may use third-party brokers, custodians, wallet providers, payment processors, and other infrastructure providers.

Trading Accounts and Account Access

Ourfinex may create, allocate, connect, or configure a trading account for the purpose of providing automated trading services.
Users may receive account information, broker information, server information, platform information, or read-only access where supported.
Read-only or investor access does not necessarily permit the user to open, modify, or close trades.
Read-only or investor access does not necessarily permit direct withdrawals from a broker account.
Ourfinex may retain operational credentials required for automated trading and account management.
Ourfinex may change, migrate, replace, or reconnect trading accounts for broker, operational, security, technical, or compliance reasons.

Trading, Leverage and Market Risk

Trading involves substantial risk and may result in partial or complete loss of trading capital.
Trading may involve leveraged products, including foreign exchange, precious metals, indices, commodities, cryptocurrencies, contracts for difference, or other supported instruments.
Leverage can magnify both gains and losses.
Market gaps, volatility, slippage, spread changes, low liquidity, execution delays, broker outages, rejected orders, force majeure, and rapid market movements may produce losses different from expected results.
Stop-loss or other risk-management instructions may not execute at the expected or requested price.
The entire trading balance may be lost.
You should use only funds that you can afford to lose without affecting essential living expenses or financial obligations.

No Guarantee of Profit

Ourfinex does not guarantee any fixed, minimum, daily, weekly, monthly, annual, or other level of profit.
Past performance does not guarantee future results.
Trader rankings, AI ratings, AI Guard results, Rate Guard filters, market sentiment, historical returns, simulations, backtests, screenshots, or displayed statistics do not guarantee future performance.
No Ourfinex employee, contractor, trader, affiliate, representative, support agent, advertisement, website content, or social-media communication is authorized to guarantee investment returns.

Trading strategies may experience losses, drawdowns, changing market behavior, or prolonged periods of underperformance.

Withdrawal Requests

Users may request withdrawals where the service and account structure support withdrawals and where sufficient withdrawable balance is available.
Withdrawal processing times displayed by Ourfinex are estimates and not guaranteed deadlines.

Withdrawals may be delayed by open trading positions, broker processing, insufficient free margin, blockchain congestion, security checks, compliance reviews, payment-provider processing, technical incidents, public holidays, or force majeure.
Ourfinex may need to reduce or close trading positions before a withdrawal can be processed.
You are responsible for providing correct bank, payment, wallet, or network details.
Completed blockchain transactions generally cannot be reversed.
Applicable network, broker, payment-provider, bank, conversion, or withdrawal charges may be deducted where disclosed or permitted.

Fees and Third-Party Costs

Ourfinex charges the applicable percentage of eligible trading profit described in these Terms.
The user may additionally incur broker spreads, commissions, swaps, financing costs, payment-processing fees, bank charges, blockchain fees, gas fees, conversion costs, withdrawal charges, or other third-party costs.
Third-party fees may change independently of Ourfinex.

Additional Ourfinex charges, if any, must be disclosed or otherwise authorized in accordance with applicable law.

Taxes

You are responsible for determining whether taxes apply to your service, trading activity, investment profits, invoices, deposits, withdrawals, or other activity.
Ourfinex may collect, withhold, report, or remit taxes where required by applicable law.
Ourfinex does not provide individual tax advice unless expressly stated otherwise.
You should consult a qualified tax professional regarding your own tax obligations.

User Responsibilities

You are responsible for reviewing your account dashboard, plan status, connected payment methods, risk settings, selected traders, trades, invoices, deposits, withdrawals, and account records.
You must notify Ourfinex promptly if you identify an incorrect charge, unknown transaction, incorrect balance, calculation discrepancy, or suspected unauthorized activity.

You must not use borrowed funds, essential household funds, emergency savings, or funds belonging to another person without lawful authorization.
You are responsible for determining whether use of Ourfinex is lawful in your country, state, province, or jurisdiction.

You must not exploit technical errors, manipulate balances or invoices, interfere with automated trading systems, or attempt to bypass service or feature restrictions.

Prohibited Activities

Ourfinex may not be used for money laundering, terrorist financing, sanctions evasion, fraud, theft, ransomware, market abuse, unauthorized payment activity, or any unlawful purpose.
Users may not create multiple accounts to evade service limits, trader-following limits, verification procedures, restrictions, payment obligations, or investigations.
Users may not submit stolen funds, compromised payment instruments, unlawfully obtained cryptocurrency, or transactions belonging to another person without authorization.
Users may not attack, reverse engineer, scrape, overload, copy, manipulate, disrupt, or gain unauthorized access to Ourfinex systems.

Ourfinex may suspend activity and preserve records where prohibited or suspicious activity is reasonably suspected.

Brokers and Third-Party Services

Ourfinex may use third-party brokers, payment processors, banking providers, trading platforms, artificial intelligence providers, data providers, wallet infrastructure, blockchain networks, custodians, hosting providers, liquidity providers, and other service providers.
Third parties may operate independently from Ourfinex and may have their own terms, fees, privacy policies, risk disclosures, limitations, and eligibility requirements.

Ourfinex does not control third-party execution, confirmation times, service availability, liquidity, insolvency risk, payment processing, banking systems, or infrastructure outages.
Ourfinex may replace or add third-party providers where reasonably necessary for operational, security, compliance, technical, or commercial reasons.

Service Availability and Changes

Ourfinex does not guarantee uninterrupted, continuous, error-free, or always-available access to the platform or trading service.
Services may be interrupted by maintenance, system failures, broker outages, payment-provider issues, cybersecurity incidents, internet failures, blockchain disruptions, market conditions, or circumstances beyond Ourfinex control.

Ourfinex may update or modify features, risk controls, AI systems, trader availability, trading strategies, supported brokers, payment methods, instruments, pricing, or service functionality.
Material changes affecting existing plan rights, pricing, recurring billing, or user funds will be communicated where required by applicable law.

Suspension and Termination

Ourfinex may suspend or terminate access where the user breaches these Terms, fails verification, presents security or fraud risk, submits suspicious transactions, fails valid payment obligations, abuses the service, or where suspension is required by law or a third-party provider.
Suspension may restrict plan features, automated trading, trader selection, account access, deposits, withdrawals, or other platform functions.
Termination does not eliminate valid obligations, liabilities, invoices, trading losses, fees, compliance holds, or disputes arising before termination.
Where legally and operationally permitted, eligible remaining funds may be made available for withdrawal after open positions, adjustments, valid charges, and required checks are completed.

Records and Account Statements

Ourfinex may maintain electronic records of plan status, plan changes, payment authorizations, invoices, payments, deposits, trading activity, balances, profit calculations, fees, and withdrawals.
Broker records, payment-provider records, blockchain data, and Ourfinex internal records may temporarily differ because of processing times, conversions, pending transactions, open positions, or corrections.

You should promptly report suspected errors after the relevant record becomes available.
Ourfinex may correct confirmed clerical, technical, pricing, duplicate, payment, broker, or calculation errors.

Billing and Account Disputes

If you believe a service charge, profit-sharing invoice, automatic debit, account entry, or other charge is incorrect, you should contact Ourfinex support promptly.
Your complaint should include your registered account information, the disputed amount, invoice or transaction reference, relevant date, and a clear explanation of the issue.
Ourfinex may request additional records or documentation to investigate the dispute.
Nothing in these Terms limits statutory rights relating to unauthorized electronic transfers, payment disputes, chargebacks, or other rights that cannot lawfully be waived.
Submitting a billing dispute does not automatically cancel your service unless you separately cancel the service or applicable law requires otherwise.

Limitation of Liability

To the maximum extent permitted by applicable law, Ourfinex is not liable for indirect, incidental, special, punitive, exemplary, or consequential damages.

Ourfinex is not liable for ordinary market losses, missed profits, strategy underperformance, liquidation, margin calls, slippage, spread changes, price movements, rejected trades, or losses inherent in trading risk.
Ourfinex is not liable for losses caused by incorrect payment information, incorrect wallet details, compromised user credentials, user-device malware, or unauthorized access resulting from the user’s failure to protect account credentials.
Ourfinex is not responsible for failures or insolvency of brokers, banks, payment processors, blockchain networks, wallets, custodians, exchanges, hosting providers, telecommunications providers, or other independent third parties except where liability cannot legally be excluded.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Ourfinex and its officers, employees, contractors, service providers, and affiliates from claims, losses, liabilities, penalties, and reasonable costs arising from your unlawful use of the service, breach of these Terms, false information, unauthorized activity, or violation of another person’s rights.
This provision does not require indemnification for liability that cannot lawfully be transferred, waived, or excluded.

Intellectual Property

Ourfinex software, source code, interfaces, trading systems, algorithms, strategy logic, AI systems, databases, trader-ranking systems, text, graphics, trademarks, logos, and branding are owned by Ourfinex or its licensors.

No ownership interest in Ourfinex intellectual property is transferred to users through a service.

Users may not copy, sell, sublicense, distribute, reproduce, modify, reverse engineer, extract, scrape, commercially exploit, or create derivative works from Ourfinex intellectual property without prior written authorization.

Privacy and Communications

Ourfinex may process personal, identity, financial, bank-account, payment, device, trading, transaction, wallet, and account information as described in its Privacy Policy and as permitted by applicable law.
You authorize Ourfinex to send operational communications concerning services, billing, invoices, automated trading, security, compliance, deposits, withdrawals, account changes, and service notices to your registered contact details.

You are responsible for keeping your email address, telephone number, payment details, and other relevant contact information current.
Marketing communications will be handled separately where opt-in, opt-out, or other consent requirements apply.

Support and Setup Assistance

If you are unfamiliar with account setup, automated trading, connecting a payment method, selecting traders, configuring risk settings, or using available Ourfinex features, you may contact Ourfinex support for assistance.

Support may explain platform functionality and setup procedures but does not guarantee trading outcomes or provide a guarantee that a particular configuration is suitable for your personal financial circumstances.
Support communications do not override these Terms unless Ourfinex expressly confirms a contractual amendment in writing.

Complaints and Disputes

Users should first submit complaints to support@Ourfinex.com.

The complaint should include the registered email address, relevant transaction or invoice references, and a clear description of the issue.
Ourfinex may request additional information or documents to investigate a complaint.
The parties should attempt in good faith to resolve disputes informally before formal proceedings where reasonably possible.
Submitting a complaint does not automatically suspend automated trading, valid billing obligations, compliance checks, security restrictions, or open trading positions.

Governing Law

Unless mandatory consumer, banking, investment, financial-services, or other applicable law requires otherwise, these Terms and Conditions are governed by the laws of the State of Delaware, United States.
Any formal proceeding will be subject to the courts, arbitration provisions, or dispute-resolution mechanism specified in Ourfinex’s final legal agreement, subject to mandatory applicable law.

Nothing in this section removes legal rights that cannot be waived under the law applicable to the user.

Amendments to These Terms

Ourfinex may update these Terms to reflect legal, regulatory, security, operational, payment, product, technical, or commercial changes.
The effective date of the current Terms will be displayed on the platform.
Ourfinex may notify users of material changes by email, dashboard notice, platform message, or another registered communication method.
Ourfinex may require users to accept updated Terms before continuing to use certain services.

Language and Translation

Ourfinex may provide these Terms in multiple languages for user convenience.
Translations are intended to communicate the same contractual meaning as the English version.
If a translated version conflicts with the English version, the English version will prevail to the extent permitted by applicable law.
Mandatory legal rights available under the user’s jurisdiction are not waived merely because the English version is designated as controlling.

Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.
An invalid provision should be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted by law.

Entire Agreement

These Terms, together with the Privacy Policy, applicable payment authorization, service disclosures, risk disclosures, and any other expressly incorporated legal terms, constitute the agreement governing your use of Ourfinex.

Product pages, marketing materials, support communications, trader statistics, or promotional content do not override these Terms unless expressly incorporated into a binding written agreement.
